When you call us:
When you telephone CLERC to ask for a referral or to speak to a lawyer, our staff will ask for your name and telephone number and information about your legal problem to fill out an “intake form”. We will give you a referral or give your information to a CLERC lawyer, who may be a volunteer lawyer, so s/he can contact you. We keep track of the number of phone calls we receive, but we do not share your personal information with anyone else unless we are required to do so by law.
When you email us:
If you simply visit our website, none of your personal information will be collected by us.
If you contact us by email, any information you provide will be kept confidential. We follow the same rules as when you telephone us. Your email address will not be shared with anyone outside of CLERC staff or a CLERC volunteer lawyer who may be assigned to help you with your legal problem. If you want one of our lawyers or staff to respond to your email, they will be given the information you provided so they can answer your question. We need to keep track of the number of people that contact us by email, but we will not share your personal information with anyone else.
Remember, email is not always 100% private, so you should always be careful about using it and about what information you provide.
Your lawyer may need some paperwork from you. Your lawyer may also keep notes, papers and documentation about your case. Your lawyer must keep your entire legal file confidential.
We need your consent to use your information
If CLERC is acting as your lawyer, you will need to give your consent for us to use any of your information.
Sometimes your consent will be assumed from your instructions. For example, if you ask your lawyer to go to court for you, your personal information will be given. Other times we may need you to tell us you consent or you may need to give us your consent in writing. Your lawyer will explain this process to you in more detail.
We may be required by law to release some of your personal information without your consent in some situations; for example, if a lawyer from CLERC has been appointed to help a judge or the court rather than as your personal lawyer.
What happens to your personal information
You have the right to ask to see the personal information we have collected on your behalf and you have the right to have any incorrect information about you that is in our records corrected.
Your personal contact information, intake form, or email inquiry, will be kept for ten years. Your file will be kept in a safe place, then destroyed when the time is up.
